Payment

  1. We accept the following Credit and Debit cards, MasterCard, Visa, Visa Delta, Switch, JCB, Eurocard and Solo,

  2. All transactions are in the United Kingdom currency of GBP£ (Great British Pounds Sterling).

  3. We reserve the right to decline transactions and/or require payment by other means at our discretion.

  4. In some instances although a Card payment has been authorised by Paypal we may need to contact you by Telephone or Email to make further enquiries and to verify the cardholders details so as to protect the card holder and guard agains fraudulent use of a card. Shipments will be held where neccessary until these checks are carried out to our satisfaction.

  5.  General Payment Terms
    Unless otherwise stated all accounts are due for payment without deduction or retention on receipt of our invoices.
    You may not withhold payment of any invoice or other amount due to us by reason of any right of set-off or counter claim which you may have or allege to have for any reason.
    If you fail to pay an invoice or any sum due to us under any contract on the due date you commit a material breach of the contract and fail to remedy that breach after being requested to do so all sums outstanding between you or your associates and us under this and any other contract shall become immediately due and payable and we shall be entitled to do any one or more of the following (without prejudice to any other right or remedy we may have): -
    a) Require payment in cleared funds before provision of further services.
    b) Cheques not honoured by your Bank will incur additional costs to cover Administration and Bank Charges
    c) Charge interest on the monies outstanding at the rate of 8 per cent above the Bank of England Official Dealing Rate in force from time to time from the due date until date of payment after as well as before judgement.
    d) Suspend or cancel the provision of further services to you or your associates under any contract without liability on our part; and terminate any contract with you or any associated person without any liability on our part.
    e) administration costs and debt recovery costs shall be applied to accounts which remain unpaid 30 days after the date of final request for payment
    f) Further/Continuing administration costs may be applied should legal action be required to recover any monies or payments outstanding.

Currency

  1. We are a United Kingdom company and charge for our products in GBP£ (Great British Pounds) at the current rate of exchange.

  2. Any dispute arising from currency issues will not be accepted by Rachel Savione Cosmetics.com, as we have taken all possible steps to alleviate any confusion over currency exchange.

Delivery Times & Postal Charges

  1. Time for performance.
    Dates for performance and/or completion of the services are given in good faith but are estimates only. Time shall not be of the essence of the contract.
    Time estimates will be revised on the date of the contract and any time estimate will not run until we are in receipt of all information required from you including any written approvals as requested by us.
    We shall not be liable for any damages whatsoever whether direct or indirect (including for the avoidance of doubt any liability to any third party) resulting from any delay by us in performing the services whether such delay or failure is caused by our negligence or otherwise howsoever.

  2. In normal circumstances we will deliver as stated within 1-5 days excluding Sundays and Bank Holidays for 1st Class Recorded Delivery or optional DHL Delivery or 5-10 days excluding Sundays and Bank Holidays for 2nd Class Recorded Delivery  - on receipt of cleared payment (3-4 Days).

  3. However there may be times when this may not be possible to meet.  We will ensure that you will receive your goods within a maximum of 30 days, or contact you in extreme circumstances to arrange a suitable delivery time.  If you are not happy with the alternative delivery date, you will be offered a complete refund.

  4. Postage rates are subject to change without notice, as we deal with a third party and are in no way able to influence their pricing policy or Terms & Conditions. All Postage and Delivery contracts are treated as seperate to the main supply of goods contract as we are bound by the terms of the Royal Mail and by accepting Rachel Savine Cosmetics' terms you also agree to accept the Royal Mail Terms and are bound by them also.

  5. Post and package rates are calculated by our shopping cart and are purely calculated on the weight of the goods ordered plus a packaging fee. 

  6. We Do not Currently Accept Orders Outside The UK
    We regret that for security reasons, delivery to addresses which are not permanent residential addresses eg. Workplace, Colleges, Hospitals, Hostels, etc.  cannot be accepted unless by prior agreement and written confirmation. Proof of Identity of the recipient may be required in these circumstances and additional costs may apply.

Back Orders And Item Substitutions

  1. From time to time, some items may be out of stock, with ourselves and our suppliers.  If it is possible to substitute with a suitable alternative, in the interests of sending out an order, we will do this for you.

  2. If you are not happy with your substitution you may return it within the Returns Conditions set out below. 

  3. Where we state "Limited Stock availability" this refers to the stock we currently hold for that item and do not anticipate being able to reorder on our suppliers. Any orders placed for an item which has Limited availability and we no longer have stock we will fully return payment for that item.

Cancellations of your order

  • If you decide to cancel your order before it has been despatched a fee of 5% will be deducted from your refund to cover the cost of administration and Credit Card processing fees.

 

Returns

We copmply with the UK Distance Selling Regulations 2000.
We will accept products back on the following conditions:

  1. The customer must contact us within 7 working days. This starts the day after the signed receipt of the goods.  You may contact us by Email, Fax or Normal Mail. (Please see Customer Service for contact details)

  2. Telephone cancellations will not be accepted as we require a cancellation in writing.

  3. The goods being returned must not be tampered with in any way.

  4. We will not accept products that have been used, or any opened packages or packages which seem to be damaged in any way. All products are accurately weighed and details logged before despatch and any items with contents missing or used will not be accepted. All returned goods must be in the "Original, Resalable As New Condition" including its packaging and any security tags must be in tact and must not have been tampered with in any way.

  5. If you decide to cancel your order, within the 7 day cooling off period from signed receipt of the goods, and have adhered to the return clauses above, we will refund your money within 30 days of the date of the cancellation less any postage and packaging costs.

  6. Where special delivery arrangements have been requested the cost of these is non-refundable under any circumstances.

  7. The cost of returning goods will be at the expense of the consumer, if you do not return the goods within the 30 days after the cancellation, we may impose a charge for the collection of the goods, and deduct this from the refund. 

  8. You are however legaly responsible for the safe delivery of the return of the goods.

  9. If in the unlikely event you receive your goods in a damaged state, you must inform us within 7 days of receipt of goods, by email or other written media to enable us to pursue a claim against Royal Mail.  This does not affect your statutory rights as a consumer.

  10. In the unlikely event of your goods being faulty we will offer to replace these goods at no extra charge, or we will offer you a full refund.  The faulty or damaged goods will be required to be returned, to enable us to claim off our suppliers or our shipping agents.  Ensure that you email us to advise of faulty goods up to seven days after you have received your goods.  We will not refund if you do not inform us after this period of time, under any circumstances.  This does not affect your statutory rights as a consumer.

  11. When you email us for a return, we will give you a reference number.  Please ensure you quote this number, with your returned item.

  12. After the 7 day Cooling off period, we charge a restocking fee of 15% of the total order if you decide to cancel your order and return your products at your own expense (Subject to Clause 4 Returns).  This does not include any postage & package fees already paid, as we will not refund these charges.

  13. Any goods returned for restocking that have been tampered with in any way will be charged at 75% of the value of the products.  As these goods are no longer legally available for resale as new.

  14. This does not affect your statutory rights as a consumer.

 


Return
of Pre-recorded Videos

  1. In accordance with the UK Distance Selling Regulations 2000 paragraph 6.1 article (e) we do not accept the return of pre-recorded videos under any circumstances. 

  2. If you have receive a faulty video you must inform us with seven working days, where a replacement will be sent to you, on receipt of the faulty video.

This site is a UK site, and any contract made by a user of this site is governed by the laws of the United Kingdom. You hereby consent to the exclusive jurisdiction of the English courts in all disputes arising out of or relating to the use of this Web site.  All transactions on this site are made in the currency of the Great British Pound (£).

General
All contracts shall be governed and interpreted according to the Law of England and Wales and you agree to submit to the non-exclusive jurisdiction of the English Courts.
The headings in these terms are for convenience only and shall not affect their interpretation. The contracts are personal to you and may not be reassigned.
Termination of any contract shall not affect the rights and obligations, which have already accrued at the time of termination.

Unsolicited Email

rachelsavinecosmetics.com Ltd will only contact you when:

  • You have consented to do so by ordering your goods.  You have the option to agree or disagree to further reasonable communication from rachelsavinecosmetics.com using the methods described in our privacy statement.

  • Your payment has not been received 14 days after your order (You will be advised that your payment has not been received for security reasons, no further reminder will be sent and the order will be cancelled).

  • You have opted to place an order by Post, Email, or Telephone, where we may need to contact you to verify certain aspects of your order.

  • via email when offers are available which may be of interest to you. You may opt out of this service by using the methods described in our privacy statement.

If in the unlikely event that you need to contact our customer services, we will endeavour to respond to any complaint within five working days not including Business Holidays and Bank Holidays.
